Did you know that if you have been given a traffic citation that has the wrong date or time on it that the citation is not a legally compliant document? If you can prove the charging document is faulty, you may be able to get the case dismissed on that basis already. This is just one of the laws of the court that can be used for your advantage and have to be obeyed by all parties, officers, and attorneys in court.
You can find the relevant laws of the court if you know what kind of court you are facing. Special rules exist for Bankruptcy court, Probate court, Family Law court, Civil Court, and Criminal Court to name a few. In Texas, for instance, there are Texas Rules of Civil Procedure (TRCP), Texas Rules of Evidence, and so on. There are also local rules that courts set up for themselves and the various codes that establish the legal requirements both to prove and to defend against legal charges.
In most kinds of court, the laws of the court actually encourage you to file your petitions, pleadings, discovery requests including subpoenas at times before and between hearings. If you have never been to court, let me encourage you to make sure your evidence, motions, pleadings and petitions are filed into the court records timely and well before you are before a judge. Attorneys specialize in seeing to it that you do not get your side of the story heard in court, so it behooves you to make sure it is in the record before you appear. Done right, such filings may make it unnecessary for you to ever appear in court in most instances - bankruptcy and family law court being notable exceptions.
How much can you afford for legal fees? Attorneys are paid whether they win or lose, so they can play court like it is a game. If they have a better winning percentage, they can justify a larger fee for their services. This is not to say a particular attorney will not care about your case, but it is likely one of many for him and the only one for you. Logically, who cares more?
For less than the cost of your attorney's time for preparation of your case, you can get training, forms, and support that will enable you to prosecute your case yourself and use strategies they don't teach in law school. Besides, if the judge strays from the laws of the court and rules quashes a motion he should not or otherwise acts unfairly, an attorney will be aware that his career may ride on whether or not he attempts to correct the judge. You, on the other hand, have no such concern and you can see to it that all parties involved play according to the laws of the court and don't make it up as they go along.
