Court Summons for Credit Card Debt: Take Immediate Action

Wondering what to do when you got served with a court summons for credit card debt? Defending yourself against debt claims starts with drafting a correct Answer to the court summons for credit card debt within the given timeframe. Usually, debtors are given 20 days to file an Answer to the summons and failure to do so will have the creditor winning the lawsuit by default. Once the creditor won the case, they have legal rights to freeze your bank account and garnish wages.

If you failed to file an Answer to the summons for credit card debt within the given period and the creditor won the case, they will be able to gain access to your own bank account and get your money or garnish your wages legally. So how do you stop this? How do you prevent your creditor from hijacking your bank account and get your wages as well?

A motion to Vacate the Judgment must be filed.

This motion will give you another chance to reverse the judgement and cite your reasons as to why you were not able to answer the court summons for credit card within the given period. Essentially, you are asking the court to have the court's ruling be dismissed and start the case all over again. You are bound to receive a court hearing date and the plaintiff or the legal representatives of your creditor will not even show up in court, thus, getting the case dismissed.

If you have a good reason as to why you missed filing an Answer to the summons for credit card debt within the given time by the court, then by all means, let them know about it by filing a Motion to Vacate Judgment. However, if you failed to secure a second chance and the ruling goes in favor of the plaintiff, your creditor will start collecting the money from your bank account or by garnishing your wages, as soon as possible. They won’t mess around either. As soon as they get a default judgment on you, they will access your bank account, get your personal, employment and banking information, garnish your wages and put liens on your prosperities!

This is the reason why drafting an Answer to the court summons for credit card debt is critical. You also need to review local court rules to learn what steps you need to take in order to win the lawsuit and prevent your creditor from getting the information they need as well as review local court rules to learn what you can do in order to answer the court summons for credit card debt on time and win the lawsuit.
