Credit Card Lawsuit Defense: What To Sign After Discovery

The Discovery phase is one of the most important phases of any credit card lawsuit. This is the part of the lawsuit where the defendant (that's you) and the plaintiff (your creditor's lawyer) will answer each other's Interrogatories and present any documented proof needed to dispute the case. Additionally, you have to learn the right documents to sign before you file the required documents during discovery.

In order to defend yourself effectively during the course of the Discovery phase, you have you first, check your local Court Rules under the Discovery or Interrogatories to Parties, Admissions, and Request for Documents. Usually, the court will impose the format for the documents and you have to comply to these rules completely. Always have the documents signed and then notarize it. There is no need to sign your name for each questions when answering the interrogatories.For instance, if you have a set of 35 Interrogatories to answer or object to, you are not required to sign each answer with your name beside the questions.

The bad news is, not many people have ideas how to apply effective credit card lawsuit defense, particularly at this point. The important thing to remember is to have all the documents signed and then notarized if required by the local court. Your creditor is counting on you making any false move so that they can win by default.

Another example would be, say you are given 35 interrogatories to answer to. Always check your local court rules on how to answer them in the imposed format and on the last question, have the document notarized after the answer. This means, you have to sign the document in front of a Notary of the Public. This way, the chances of the documents you presented being returned to you due to errors will be slim to none.

Defending yourself in court is not as complicated as it seems. The important thing to consider is how you can be one step ahead of your creditor.
