Tips on How To Avoid Credit Card Debt Lawsuits

Charges in relation to CC debt are usually caused by ignoring the summons. If debtors continuously ignore the court summons, it gives junk debt buyers the reason to go after them and collect the debt. Junk debt buyers and collection agencies usually expect an easy victory with the court ruling out a default judgment against the debtor because creditors assume debtors know nothing about defending themselves against credit card lawsuit.

Unfortunately, if you failed to respond to the summons within the right time, you could lose the case and this will give your creditor rights to collect the debt by getting the funds straight from your bank account, put liens on your assets or garnish your wages. Here are ways to avoid the situation from going from bad to worse.

Ignoring The Problem

Usually, you have to answer to all notifications you get from your creditor or junk debt buyer with a denial, dispute or demand debt validation. If you don’t, your creditor will press charges against you and the case will be taken to court.

No Follow Up Letters

If you received a poorly documented debt validation for the money you allegedly owe and you did not contest the evidence or denied ownership of the debt, this gives your creditor the impression that you are ignorant of your rights and will pursue the case expecting an easy win.

Taking Phone Calls

You must never take any calls from your creditor and in the case that you do, make sure you let the person on the other line know that you are recording the conversation. Most creditors are always looking for ways to catch debtors off guard so don’t give them any reason to believe that you don’t know what to do otherwise, they will hound you with phone calls and threats.

Never Give Sensitive Information!

Remember, anything you say with a debt attorney may haunt you once the legal proceedings take place. Never give any sensitive information because they will use this to find where you work, where you live and might lead to them discovering your bank account!

Admitting The Debt

Do not admit the debt in dispute on the phone or worse, in writing. If you do this, the creditor won’t even need to go to court to come after you. You admitted that you did not pay the debt and you need to repay it one way or another. it shows you don't even know the first thing about how to fight credit card lawsuit and you are handing out your money readily.
