You got a DUI and you have decided to fight the charge, but you are still uncertain about what you will face. Here are the 4 proceedings you can expect if you are charged with driving under the influence.

It’s important that you remain composed and act in your own best interest. You demeanor and how you navigate the process may influence the outcome. Be prepared to go through these 4 proceedings.

Arraignment Hearing. This is when you officially hear the charges against you. They will be read aloud in the court. You will then be asked to enter a plea. Typically you would reply guilty, not guilty or no contest. No contest neither admits nor denies the charge. Most people will enter a not guilty plea at this time since you will have the opportunity to change you plea at a later date.

Preliminary Hearing. You will hear the evidence the state has to support their claim that you have committed a DUI or DWI. You can expect the results of a BAC test that shows your blood alcohol level, a statement from the arresting officer and any eyewitness testimony. You will have the answer this evidence if you are preparing a defense so it is important that you fully account for it.

Pre-trial Motions. This is where you can challenge evidence by filing pre-trial motions. For example, you might challenge the BAC reading by saving that the equipment was defective or the test was administered incorrectly. You might also challenge the reason you were stopped and if it was valid.

Trial. This is typically the final stage. Your case will be heard before a jury of your peers. They will listen to both the prosecution (the state presenting the charges against you) and your defense. Ultimately, the jury will find you guilty or not guilty.

A DUI is a serious charge that can result in jail time and/or heavy financial implications. Being found guilty can impact your employment or your ability to find employment.
